Nebraska Delta-8 THC Laws
Nebraska passed the Hemp Farming Act in 2019, officially making hemp and hemp-derived products legal in the state.
The Act specifies that hemp products are exempt from the list of controlled substances:
Hemp means the plant Cannabis sativa L. and any part of such plant, including the viable seeds of such plant and all derivatives, extracts, cannabinoids, isomers, acids, salts, and salts of isomers, whether growing or not, with a delta-9 tetrahydrocannabinol concentration of not more than 0.3 percent on a dry weight basis. Hemp shall be considered an agricultural commodity. Notwithstanding any other provision of law, hemp shall not be considered a controlled substance under the Uniform Controlled Substances Act

What is Delta-8 THC?
Delta 8 is a form of tetrahydrocannabinol (THC), the intoxicating compound in cannabis. Cannabis plants contain high levels of delta-9, which is the most common form of THC (1).
Delta 8 has similar but milder euphoric effects than delta 9 and is only found in trace quantities in cannabis.
Why Delta-8 THC is Federally Legal
The 2018 Farm Bill legalized hemp, which is defined as any cannabis plant or product containing no more than 0.3% delta-9 THC.
