Is CBD Legal in Australia?

Yes, but it’s not that simple. In December 2020, Australia’s regulatory health authority, the TGA, legalized low-dose (up to 150 mg/day) CBD products at pharmacies. That means you can buy them without a prescription.

But there’s a catch: these products must first be approved. They might not be available until 2024 or later. So, even though CBD products are now legal in Australia, you can’t get them quite yet.

Another limitation is that they must contain at least 98% CBD. So other beneficial hemp cannabinoids may have to be removed from full-spectrum products, making them less potent.

How to Buy CBD Gummies in Australia

There are three ways to buy CBD products in Australia:

  1. Over-the-counter at pharmacies (not available yet)
  2. A prescription from a doctor
  3. Online from international CBD brands

Low-dose CBD products became legal over-the-counter in Australian pharmacies in 2020 but won’t be available until at least late 2023.

You can also access CBD products with a doctor’s prescription through the Special Access Scheme (SAS) system, but that takes time, meeting eligibility criteria, and often additional costs for consultation.

The last and simplest option is to buy CBD gummies from international brands that ship to Australia. You can either buy directly from the brand or use a mail-forwarding service. The main downside of shopping online is that it’s not exactly allowed, so there’s a small risk of having your product seized at the border.

History of CBD Laws in Australia

CBD’s legal status in Australia is linked to cannabis. Australian states started banning cannabis in the 1920s and 1930s, much like the U.S. did during the 20th century.

In 2016, Australia legalized medical cannabis, including CBD. So, with a doctor’s note, people could get CBD. But, using cannabis and CBD recreationally is still illegal. The only exception is the Australian Capital Territory (ACT), which legalized cannabis in 2019.

However, it’ll be some years before Australians can buy CBD without a prescription because of a long approval process. We’ll have to wait until at least 2024 before these products become available.
